I have reviewed applicable stated codes in Oregon, Washington and Californiaaddressing vehicle load limits. They are all based on maximum load per axle and/or per tire. There is no mention of a truck manufacturer's GVWR or GAWR. This indicates to me that the states' concerns are with the weight on the road surface (i.e., roadway wear and tear), and not on whether the load exceeds the manufacturer's rating. The codes have other sections that address vehicle safety, but again I can't find any reference to manufacturer ratings.

QUESTION: Is anyone aware of any state code that specifically prohibits a person from driving a vehicle at a weight that exceeds the manufacturer's gross weight ratings?

 

In SC, No. They only check commercial vehicles. If you are involved in an accident then they make it due to driver error or vehicle not upkept to par. I think it just affects warantee stuff if something breaks and they can prove you were overloaded.
